| Leyes | Por real decreto se incorpora al derecho interno las directivas 2002/96/CE del Parlamento Europeo y del Consejo, de 27 de enero de 2003, sobre residuos de aparatos eléctricos o electrónicos, modificada en su artículo 9 por la Directiva 2003/108/CE del Parlamento Europeo y del Consejo, de 8 de diciembre de 2003. Se dicta al amparo de lo establecido en los artículos 1 y 7 de la Ley 10/1998, de 21 de abril, de Residuos, que faculta al Gobierno para fijar disposiciones particulares relativas a la producción y gestión de determinados tipos de residuos de manera que se facilite su reutilización, reciclado y valorización. |

Nº 230/2004 de 10 de Dezembro Estabelece o regime jurídico a
a que fica sujeita a gestão de resíduos de equipamentos eléctricos e
electrónicos (REEE), com o objectivo prioritário de prevenir a sua
produção e, subsequentemente, promover a reutilização, a reciclagem
e outras formas de valorização, de modo a reduzir a quantidade e o carácter
nocivo dos resíduos eléctricos e electrónicos a serem geridos,
visando melhorar o comportamento ambiental de todos os operadores
envolvidos no ciclo de vida destes equipamentos. |

The WEEE Directive is not currently implemented in the United Kingdom In December 2005 the Energy Minister, Malcolm Wicks, announced that the implementation of the WEEE Directive in the UK would be delayed and that the Government would undertake an immediate review of the proposals for implementation. Click here for details. The decision reflects the continuing concerns expressed by businesses and stakeholders and the Government's commitment to implementing the Directive in the UK in a way which maximises the environmental benefits associated with the Directive and minimises the costs to business. The review will be followed by a full consultation exercise in Spring 2006 before the Government proceeds to transpose the main provisions of the Directive into UK law. |

On 30 July 2004, the Government published a consultation paper seeking views from stakeholders on the draft implementing Regulations and non-statutory guidance for WEEE and RoHS.
This consultation has now closed. An executive summary and an assessment of responses to this consultation has been published. These documents can be viewed/downloaded using links below.
The National Clearing House Project Group was a small stakeholder group convened by DTI during the consultation period. It has sent a paper to the DTI on issues associated with allocation of WEEE to producers. This may be viewed/downloaded using the link below.
The WEEE Directive includes permitting requirements for treatment of WEEE. For England and Wales these are expected to be transposed into law by new regulations, which DEFRA will make. These permitting regulations are to be the subject of a separate consultation. Information on the waste permitting review may be viewed here. The Northern Ireland Administration has consulted separately on proposals for its transposition of the permitting and treatment requirements of the WEEE Directive. Its consultation paper can be viewed here. The consultation ended 8 October 2004. Separate regulations implementing the treatment requirements of the WEEE Directive will be made in Scotland. The Environment
Agency has consulted on draft guidance for treatment and storage of WEEE
at treatment facilities. This consultation closed 29 October 2004. This
